These terms apply to Fysico Fitness (gym and classes). This English translation is provided for convenience only; in case of any difference, the Dutch version prevails. For physiotherapy, our following terms apply: house rules and payment terms.

1. About these terms
1.1 These terms apply to all memberships, visit cards and classes of Fysico Fitness, part of Maatschap Fysico Rotterdam, Bentinckplein 12, 3039 KL Rotterdam, Chamber of Commerce (KvK) 86369288 (hereinafter: Fysico).
1.2 By “member” we mean anyone who purchases a membership or a single class at Fysico. For members under 18, a parent or guardian also enters into the agreement.
2. Registration and age
2.1 The minimum age is 12.
2.2 After registering you receive an access pass, or you can buy a token (key fob or wristband) for a fee. The pass or token is yours. If you lose it, you can buy a new one at reception.
2.3 Show your pass or token when you come in. Without a pass we may ask you to identify yourself.
3. Payment
3.1 You pay the membership fee in advance by direct debit.
3.2 If a direct debit fails, we will send you a reminder. If you still don't pay, we will send a final notice giving you 14 days to pay without extra costs. If you don't pay after that either, we may charge the statutory collection costs and interest and hand the claim over to a collection agency.
3.3 If your payments are more than 4 weeks in arrears, we may refuse you access until the arrears have been paid. If they are more than 8 weeks in arrears, we may terminate the agreement in writing.
3.4 If you are temporarily unable to train, the membership fee remains payable, except in the situations described in article 6 (medical pause).
4. Term and cancellation
4.1 A membership has the term stated on your registration, for example one month or one year. An annual membership has a lower price and runs for 12 months.
4.2 After the initial term, your membership continues for an indefinite period. You can then cancel it at any time with a notice period of 1 week.
4.3 You cancel at reception or by email to info@fysicorotterdam.nl. You will always receive a confirmation.
4.4 If you move to an address more than 10 km from Fysico, you can cancel with a notice period of 2 weeks, with proof of your move.
4.5 In the event of a member's death, we end the membership on the earliest possible date.
4.6 Holidays or a temporary stay abroad are not a reason to cancel a fixed-term membership early.
5. Not satisfied? Money back
If you are not satisfied, you can end your membership within 28 days of the start date, provided you have come to train at least 4 times in that period. The registration fee and the membership fee for the first period are not refunded.
6. Medical pause
6.1 If you are temporarily unable to train for medical reasons, you can pause your membership for up to 3 months. You will need to show proof, such as a statement from your physiotherapist or GP, or an appointment confirmation from a specialist.
6.2 During the pause you pay no membership fee. Any fee already paid for that period will be settled with you. The term of an annual membership is extended by the length of the pause.
6.3 If you want to pause your membership temporarily for another reason, we charge € 10 in administration fees.
7. Price changes
7.1 We may adjust our fees once a year in line with inflation (the CBS consumer price index), and pass on VAT changes made by the government immediately. You will be informed at least one month in advance.
7.2 If the price goes up within 3 months of taking out your membership, you may cancel your membership free of charge as of the date of the increase.
7.3 If the price increases by more than inflation, you may always cancel free of charge as of the date of the increase.
8. Opening hours and services
8.1 We determine the opening hours and the class schedule. We are generally closed on official public holidays. During holiday periods, hours and schedules may be adjusted. We announce changes in good time.
8.2 Minor and temporary changes to opening hours or the schedule do not entitle you to a discount or refund. If the services are reduced substantially and for a long period, you may cancel your membership free of charge.
9. House rules
9.1 You follow the instructions of our staff and the house rules. Train in clean indoor shoes and sportswear and use your own towel.
9.2 Use your phone with respect for others; preferably take calls in the changing room or hallway. Do not take photos or videos of other members without their permission.
9.3 Alcohol and drugs are prohibited, as is being under their influence. Doping and other performance-enhancing substances are prohibited.
9.4 Personal training may only be given by trainers who have an agreement with Fysico.
9.5 If you seriously or repeatedly fail to comply with these rules, we may refuse you access and terminate the agreement with immediate effect.
10. Health and liability
10.1 Train within your own abilities and inform us of any health complaints or limitations relevant to your training.
10.2 Fysico is not liable for damage or injury sustained while exercising, unless the damage is the result of intent or negligence on the part of Fysico or its staff.
10.3 Fysico is not liable for loss, theft or damage to your belongings, including in the changing room or for parked bicycles and vehicles. Please use the lockers.
10.4 Damage you cause through your own fault to equipment, the building or other members is at your own expense.
11. Personal data
We handle your personal data with care. Read how in our privacy statement. Please notify us yourself of any changes to your address, email address, phone number or bank account number.
12. Complaints
12.1 Do you have a complaint about Fysico Fitness? Discuss it with a trainer or email info@fysicorotterdam.nl. Please report your complaint within 4 weeks if possible, so we can look into it properly.
12.2 We will respond within 2 weeks. If we need more time, we will let you know.
12.3 If we cannot resolve it together, you can turn to the competent court in Rotterdam.
13. Final provision
These terms and all agreements with Fysico are governed by Dutch law. We may change these terms; we will announce substantial changes at least one month in advance.
